3.1    BE IT RESOLVED, that the Board of Education accepts the minutes of the June 12, 2019 Board Meeting

3.2    BE IT RESOLVED, that the Board of Education accepts the minutes of the June 14, 2019 Special Board Meeting.

3.3    Policy #5065:  Immunizations & Health Examinations – 1st Reading and Adoption.
BE IT RESOLVED, that the Board of Education hereby waives a second reading of Policy #5065:  Immunizations & Health Examinations  and,

BE IT FURTHER RESOLVED, that upon the first reading of this regulation as presented at this meeting, the Board of Education hereby adopts Policy #5065:  Immunizations & Health Examinations.

Mr. Robert Krausz, Teacher of Theater, Horace Greeley High School, to a probationary appointment in the tenure area of Art effective August 29, 2019 through August 28, 2023, subject to receipt of composite or overall annual professional performance review ratings pursuant to Education law Section 3012-c and/or 3012-d of either effective or highly effective in at least three (3) of the four (4) proceeding years, and if the probationer receives an ineffective composite or overall rating in the final year of the probationary period he or she shall not be eligible for tenure at that time.

Mr. Libardo Valencia, Teacher of Mathematics, Horace Greeley High School, to a probationary appointment in the tenure area of Mathematics effective August 29, 2019 through August 28, 2023, subject to receipt of composite or overall annual professional performance review ratings pursuant to Education law Section 3012-c and/or 3012-d of either effective or highly effective in at least three (3) of the four (4) proceeding years, and if the probationer receives an ineffective composite or overall rating in the final year of the probationary period he or she shall not be eligible for tenure at that time.

Mr. Madison Martineau, Teacher of Music, Robert E. Ms. Sara Lewis, Guidance Counselor, Horace Greeley High School, to a probationary appointment in the tenure area of Guidance effective August 29, 2019 through August 28, 2022, subject to receipt of composite or overall annual professional performance review ratings pursuant to Education law Section 3012-c and/or 3012-d of either effective or highly effective in at least three (3) of the four (4) proceeding years, and if the probationer receives an ineffective composite or overall rating in the final year of the probationary period he or she shall not be eligible for tenure at that time.

Ms. Lisa Balbona, Teacher of Elementary Education, Westorchard Elementary School, to a probationary appointment in the tenure area of Elementary Education effective August 29, 2019 through August 28, 2023, subject to receipt of composite or overall annual professional performance review ratings pursuant to Education law Section 3012-c and/or 3012-d of either effective or highly effective in at least three (3) of the four (4) proceeding years, and if the probationer receives an ineffective composite or overall rating in the final year of the probationary period he or she shall not be eligible for tenure at that time.

Ms. Kayla Arno, Teacher of Elementary Education, Douglas Grafflin Elementary School, to a probationary appointment in the tenure area of Elementary Education effective August 29, 2019 through August 28, 2023, subject to receipt of composite or overall annual professional performance review ratings pursuant to Education law Section 3012-c and/or 3012-d of either effective or highly effective in at least three (3) of the four (4) proceeding years, and if the probationer receives an ineffective composite or overall rating in the final year of the probationary period he or she shall not be eligible for tenure at that time.

Adam Schoenbart, Assistant Principal, Horace Greeley High School, to a probationary appointment in the tenure area of High School Assistant Principal effective July 29, 2019 through July 28, 2023, subject to receipt of composite or overall annual professional performance review ratings pursuant to Education law Section 3012-c and/or 3012-d of either effective or highly effective in at least three (3) of the four (4) proceeding years, and if the probationer receives an ineffective composite or overall rating in the final year of the probationary period he or she shall not be eligible for tenure at that time. 

4.2   Non-Instructional 

Appointment:
Pamela Rodriguez, Computer Aide (Session), Robert E. Bell Middle School, 35 hrs/week, effective September 3, 2019.

5.1    CSE Summaries (2019-20 School Year) reported to the Board on June 25, 2019.

5.2    BE IT RESOLVED, that the Board of Education approves a gift from the Roaring Brook Elementary School PTA, in the amount of $1,181.74 for the renovation of the Roaring Brook gazebo.

5.3    BE IT RESOLVED, that the Board of Education approves a gift from the Robert E. Bell Middle School PTA, in the amount of $4,434.32 for the purchase new sound equipment and a renovation of the Bell Garden.

5.4    BE IT RESOLVED, that the Board of Education approves a Chappaqua School Foundation InstaGrant Gift for “The Literate Brain:  Linking Researchers with Practitioners”, a summer literacy research institute, in the amount of $2,500.00, submitted by Horace Greeley High School Literacy Teacher Susan Miller.

5.5    BE IT RESOLVED, that the Board of Education approves a proposal from Johnson Controls 
for the Library at Horace Greeley High School, for all materials and labor for project management, design engineering, technical installation and customer training to: 
1) Furnish, install and wire 10 BACnet JCI Metasys network room sensors, 2) Furnish, install and wire 1 JCI Metasys MS-FEC Field Controller, 3) Furnish, install and wire 1 JCI Metasys MS-IOM input/output modules, 4) Extend Communication Wiring to new panel, 5) Custom graphics created and installed at owner’s front-end operator workstation, and  6) Commission and demonstrate to owner’s representative, in the amount of $27,500.00, and authorizes the Board President to execute the agreement.

5.6    BE IT RESOLVED, that the Board authorizes the law firm of Shaw, Perelson, May & Lambert, LLP to appeal the May 20, 2019 Decision Order & Judgment in Bailenson et. al. v. Board of Education, etc., Index No. 70427/18 to the Second Department of the Appellate Division of the N.Y.S. Supreme Court under the terms of the retainer agreement between that law firm and the Chappaqua Central School District.

5.7    BE IT RESOLVED, that the Board authorizes the law firm of Shaw, Perelson, May & Lambert, LLP to appeal the May 29, 2019 Decision Order & Judgment in Pacher et. al. v. Chappaqua Central School District, Index No. 70408/18 to the Second Department of the Appellate Division of the N.Y.S. Supreme Court under the terms of the retainer agreement between that law firm and the Chappaqua Central School District.

5.8    BE IT RESOLVED, that the Board hereby ratifies the terms of a Supplemental Memorandum of Agreement with the CSEA, Local 1000 AFSCME, AFL-CIO, Chappaqua CSD Unit no. 9226 Westchester County Local 860, dated June 25, 2019, regarding the creation of a stipend position of Coordinator of the Seven Bridges Performing Arts Center, as presented to the Board at this meeting. A copy of said Supplemental Memorandum of Agreement shall be incorporated by reference within the minutes of this meeting.

5.9    BE IT RESOLVED, that the Board hereby ratifies the terms of a Supplemental Memorandum of Agreement with Chappaqua Congress of Teachers (CCT) bargaining unit, dated June 25, 2019, regarding the addition of three fellowship opportunities for the 2019/20 and 2020/21 academic years, and one fellowship opportunity for the 2019/20 academic year, as presented to the Board at this meeting.  A copy of said Supplemental Memorandum of Agreement shall be incorporated by reference within the minutes of this meeting.

5.10    BE IT RESOLVED, that the Board hereby ratifies the terms of a Supplemental Memorandum of Agreement with Chappaqua Congress of Teachers (CCT) bargaining unit, dated June 25, 2019, regarding certain amendments to the 2018-21 CCT Teacher’s Collective Bargaining Agreement, as presented to the Board at this meeting.  A copy of said Supplemental Memorandum of Agreement shall be incorporated by reference within the minutes of this meeting.

5.11    BE IT RESOLVED, that the Board hereby ratifies the terms of a Supplemental Memorandum of Agreement with the Chappaqua Administrators’ Association (CAA) bargaining unit, dated June 25, 2019, regarding a salary adjustment for unit member Lauralyn Stewart, as presented to the Board at this meeting.  A copy of said Supplemental Memorandum of Agreement shall be incorporated by reference within the minutes of this meeting.

5.12    BE IT RESOLVED, that the Board of Education hereby approves Bradhurst Site Construction Change Order #4 to furnish and install an irrigation system as part of Athletic Field Improvements at the Robert E. Bell Middle School, in the amount of $63,630.00 and authorizes the Board President to execute the agreement.

5.13    BE IT RESOLVED, that the Board President is authorized to sign the retainer agreement with the law firm of Shaw, Perelson, May & Lambert, LLP for the 2019-20 school year as presented to the Board at this meeting.  A copy of said retainer agreement shall be incorporated by referenced within the minutes of this meeting.

5.14    BE IT RESOLVED, that the Board of Education approves an Agreement with Sivic Solutions Group, LLC, effective July 1, 2019 to June 30, 2020, at the rate set by the New York State Education Department, and authorizes the Board President to execute this Agreement.

5.15    BE IT RESOLVED, that the Board of Education approves the Contract with SCO Family of Services, Westbrook Preparatory School for the educational services, effective July 1, 2019 to June 30, 2020, at the rate set by the New York State Education Department, and authorizes the Board President to execute this Agreement.

5.16    BE IT RESOLVED, that the Board of Education approves the Independent Evaluation Agreement with Dr. Suzanne Braniecki, for an independent neuropsychological evaluation for student #702174, in the amount not to exceed $2,900.00, and authorizes the Board President to execute this agreement.

5.17    BE IT RESOLVED, that the Board of Education approves the Agreement for Services with NWEA, for professional development in MAP Growth Math, Reading & Language during school year 2019-20, in the amount not to exceed $20,575.00, and authorizes the Board President to execute this agreement.

5.18    BE IT RESOLVED, that the Board of Education approves a new Lease Agreement,  dated June 21, 2019, with Xerox Financial Services regarding copier machines, and authorizes the Board President to execute this agreement.

5.19    BE IT RESOLVED to increase the “Sick/Compensated Absences” budget line (A2110-139-36-251) by the amount of $71,223.89, and the “Compensated Absences” budget line (A9089-880-36) by $133,445.50, as an additional budget appropriation to the 2018-19 budget and that such appropriation be funded from the Employee Benefit Accrued Liability Reserve Fund.

5.20    BE IT RESOLVED, THAT THE Board of Education hereby approves CCSD Bid #B2019-14:  Security Project at Robert E. Bell Middle School to be awarded to Casbella Contracting of NY, Inc., in the amount of $250,000.00 and authorizes the Board President to execute the agreement.

5.21    BE IT RESOLVED, that the Board of Education hereby appoints Dr. Christine Ackerman as Superintendent of Schools of the Chappaqua Central School District for the period of time commencing on June 25, 2019 and terminating on June 24, 2024; and

BE IT FURTHER RESOLVED, that the Board hereby authorizes its President to execute an Agreement with Dr. Ackerman which sets forth the terms and conditions of her employment as Superintendent of Schools during the period from June 25, 2019 through June 24, 2024, a copy of which Agreement shall be incorporated by reference within the minutes of this meeting; and

BE IT FURTHER RESOLVED, that effective June 25, 2019, the Superintendent’s Contract dated June 29, 2018, is hereby declared null and void and of no further effect.

BE IT RESOLVED, that the Board of Education acknowledges Change Orders approved by the Superintendent per Board Resolution adopted at June 14, 2017 Board of Education meeting

6.1    Change order #HGHS MC-006 approved by the Superintendent:
Project:  HGHS & Library Capital Improvements
Contractor:  Southeast Mechanical Corp.
Description:  Labor and materials to provide additional transfer registers and ductwork modifications as directed by engineer in response to RFI #22 dated 2/17/19, drawing M-206 and PCO #09 dated 2/25/19.
Amount:  $13,005.32

6.2    Change order #HGHS GC-009 approved by the Superintendent:
Project:  HGHS & Library Capital Improvements
Contractor:  MVM Construction LLC
Description:  Miscellaneous general construction and adjustments as described in the attached PCOs #7 dated 11/28/18, #17 dated 1/23/19, #25 dated 1/23/19 and #48 dated 4/24/19 with drawing A-206.
Amount:  $17,099.28

6.3    Change order Bradhurst #3 approved by the Superintendent:
Project:  Robert E. Bell Middle School Athletic Field Improvements
Contractor:  Bradhurst Site Construction Corp.
Description:  Expanding the turf restoration area based on updated site conditions from date of bid doc issuance.
