BE IT RESOLVED that the Board of Education adopts the 2016-17 school district budget in the amount of $118,225,288.

BE IT RESOLVED that the Board of Education approves the Property Tax Report Card for the 2016-17 school year based upon the adopted 2016-17 budget.

 

 

5.4

WHEREAS, the Board of Education of the Chappaqua Central School District has developed a Preliminary Smart Schools Investment Plan, dated January 22, 2016; and

WHEREAS, the Preliminary Smart Schools Investment Plan was posted on the District's website for a period of at least 30 days prior to the public hearing on the Preliminary Smart School Investment Plan providing the public with the opportunity to submit written comments; and

WHEREAS, a public hearing on the Preliminary Smart School Investment Plan was held on March 16, 2016, to allow for public comment and involvement; and

WHEREAS, no responses and public comments were received, the Board of Education has determined to adopt its Preliminary Smart Schools Investment Plan, as its Final Smart Schools Investment Plan, which will be dated April 13, 2016;

THEREFORE, BE IT RESOLVED, that the Board of Education hereby approves and adopts the Final Smart Schools Investment Plan dated April 6, 2016 and hereby directs the Superintendent of Schools to submit the Final Smart Schools Investment Plan to the New York State Education Department and to take all other necessary actions as required by the Smart Schools Bond Act.

RESOLUTION OF THE CHAPPAQUA CENTRAL SCHOOL DISTRICT, NEW YORK, ADOPTED APRIL 13, 2016, CALLING A SPECIAL DISTRICT MEETING TO AUTHORIZE THE EXPENDITURE OF MONEYS FOR SCHOOL AND LIBRARY PURPOSES AND THE LEVY OF A TAX THEREFOR.

RESOLVED BY THE BOARD OF EDUCATION OF THE CHAPPAQUA CENTRAL SCHOOL DISTRICT, IN THE COUNTY OF WESTCHESTER, NEW YORK AS FOLLOWS:

Section 1. A Special District Meeting of the qualified voters of the Chappaqua Central School District, in the County of Westchester, New York (the "District"), shall be held within the District, on Tuesday, June 14, 2016, at 7:00 o'clock A.M. (Prevailing Time) at the Gymnasium of the Horace Greeley High School, Chappaqua, New York, as provided in the Notice calling said Special District Meeting hereinafter substantially prescribed. The voting at such Special District Meeting shall be by voting machine, as provided by the Education Law, and the polls shall remain open from 7:00 o'clock A.M. to 9:00 o'clock P.M. (Prevailing Time) on said day and as much longer as may be necessary to enable the voters, then present, to cast their votes.

Section 2. The business to be acted upon at said Special District Meeting shall be as stated in the Notice thereof, and the District Clerk is hereby authorized and directed to cause the Notice of said Special District Meeting to be published in "The Journal News" and "The Examiner," two newspapers having a general circulation within the School District, such publications to be made four (4) times in each such newspaper within the seven (7) weeks next preceding such Special District Meeting, the first publications to be at least forty-five (45) days prior to the date of said Special District Meeting.

Section 3. Said Notice of Special District Meeting shall be substantially in the following form:

CHAPPAQUA CENTRAL SCHOOL DISTRICT,
IN THE COUNTY OF WESTCHESTER, NEW YORK

NOTICE IS HEREBY GIVEN that pursuant to a resolution of the Board of Education of the Chappaqua Central School District, in the County of Westchester, New York, adopted on April 13, 2016, a Special District Meeting of the qualified voters of said School District will be held on

Tuesday, June 14, 2016

from 7:00 o'clock A.M. to 9:00 o'clock P.M. (Prevailing Time) at the Gymnasium of the Horace Greeley High School, Chappaqua, New York for the purpose of voting upon the following Bond Proposition:

BOND PROPOSITION

RESOLVED:

(a) That the Board of Education of the Chappaqua Central School District, in the County of Westchester, New York (the "District"), is hereby authorized to undertake a District-wide capital improvement project (the "Project") substantially as described in a "Capital Bond Proposal," dated March 30, 2016, prepared by the District with the assistance of Kaeyer, Garment & Davidson, Architects, P.C. (the "Proposal"), available for public inspection in the office of the District Clerk and on the District's website, consisting of the construction of alterations and improvements to District buildings and sites, and the Chappaqua Public Library; including construction of additions and interior reconstruction and reconfiguration space to create global and STEAM learning centers and new public library space; upgraded science, auditorium and other educational space; building code, ADA, roof, door, window, ceiling, floor, security, lavatory, locker, heating, ventilation and air-conditioning improvements; playground and athletic field improvements including installation of synthetic turf fields and field lighting; and curb, sidewalk, paving, masonry and other building exterior improvements; all of the foregoing to include the original furnishings, equipment, machinery, apparatus and ancillary or related site, demolition and other work required in connection therewith; and to expend therefor, including preliminary costs and costs incidental thereto and to the financing thereof, an amount not to exceed the estimated total cost of $42,500,000; provided that the costs of the components of the Project as set forth in the Proposal may be reallocated among such components if the Board of Education shall determine that such reallocation is in the best interests of the District;

(b) that a tax is hereby voted in the aggregate amount of not to exceed $42,500,000 to pay such cost, said tax to be levied and collected in installments in such years and in such amounts as shall be determined by said Board of Education; and

(c) that in anticipation of said tax, bonds of the District are hereby authorized to be issued in the principal amount of not to exceed $42,500,000 and a tax is hereby voted to pay the interest on said bonds as the same shall become due and payable.

Such Bond Proposition shall appear on the ballot used for voting at said Special District Meeting in substantially the following condensed form:

(a) That the Board of Education of the Chappaqua Central School District, in the County of Westchester, New York (the "District"), is hereby authorized to construct alterations and improvements to District buildings and sites, including the Chappaqua Public Library, and to expend therefor, including preliminary costs and costs incidental thereto and to the financing thereof, an amount not to exceed the estimated total cost of $42,500,000; (b) that a tax is hereby voted in the aggregate amount of not to exceed $42,500,000 to pay such cost, said tax to be levied and collected in installments in such years and in such amounts as shall be determined by said Board of Education; and (c) that in anticipation of said tax, bonds of the District are hereby authorized to be issued in the principal amount of not to exceed $42,500,000 and a tax is hereby voted to pay the interest on said bonds as the same shall become due and payable.

The voting will be conducted by ballot on voting machines as provided in the Education Law and the polls will remain open from 7:00 o'clock A.M. to 9:00 o'clock P.M. (Prevailing Time) and as much longer as may be necessary to enable the voters then present to cast their ballots.

NOTICE IS FURTHER GIVEN that registration of voters is required pursuant to Section 2014 of the Education Law. If a voter has registered to vote with the School District and has voted at an Annual or Special School District meeting within the last four calendar years, (after January 1, 2012) s/he is eligible to vote at this Special District Meeting. If a voter is currently registered to vote with the Westchester County Board of Elections, s/he is also eligible to vote at this Special District Meeting. All other persons who wish to vote must register. Registration may be done on any business day at the Office of the District Clerk, during business hours, at the Education Center at 66 Roaring Brook Road, Chappaqua, up to June 9, 2016, five (5) days prior to the Special District Meeting. Any person possessing all of the following qualifications may register to vote:

  1. Is a citizen of the United States; and
  2. Is eighteen years of age or older; and
  3. Has resided in the School District for a period of thirty days immediately preceding the day of the Special District Meeting.

NOTICE IS FURTHER GIVEN that the register of voters so prepared shall be filed in the Office of the School District Clerk and shall be open for inspection by any qualified voter of the District between the hours of 8:30 o'clock A.M. and 4:30 o'clock P.M. (Prevailing Time) beginning June 9, 2016, except Sunday. Said register will be open for inspection at the polling place on the date of the Special District Meeting.

NOTICE IS FURTHER GIVEN that applications for absentee ballots may be obtained during school business hours from the School District Clerk. If the ballot is to be mailed to the voter, the completed application must be received by the District Clerk no later than 4:00 o'clock P.M. (Prevailing Time) on Tuesday, June 7, 2016. If the ballot is to be delivered personally to the voter, the completed application must be received by the District Clerk no later than 4:00 o'clock P.M. (Prevailing Time) on Monday, June 13, 2016. Absentee ballots must be received by the District Clerk not later than 5:00 o'clock P.M. (Prevailing Time), on Tuesday, June 14, 2016.

NOTICE IS FURTHER GIVEN that a list of all persons to whom absentee ballots shall have been issued will be available for inspection by qualified voters of the District in the said Office of the District Clerk during regular office hours, 8:30 o'clock A.M. to 4:30 o'clock P.M. (Prevailing Time) until the day of the Special District Meeting. Any qualified voter may file a written challenge of the qualifications of a voter whose name appears on such list, stating the reasons for the challenge.

Only qualified voters who are duly registered will be permitted to vote.

Section 4. The vote upon the Bond Proposition to be submitted to the qualified voters shall be by ballot on voting machines, and the District Clerk is hereby authorized and directed to have the necessary ballot label printed for the said voting machines, in form corresponding as nearly as may be with the requirements of the Education Law.

Section 5. The proceeds of the bonds authorized pursuant to the Bond Proposition set forth in Section 3 hereof, and any bond anticipation notes issued in anticipation of said bonds, may be applied to reimburse the District for expenditures made for the purpose or purposes for which said bonds are authorized. The foregoing statement of intent with respect to reimbursement is made in conformity with Treasury Regulation Section 1.150-2 of the United States Treasury Department.

Section 6. This resolution shall take effect immediately.

BE IT RESOLVED that the Board of Education approves the appointment of election personnel for May 17, 2016 School Budget Vote/Election.

BE IT RESOLVED that the Board of Education approves an Agreement with KG&D Architects dated March 7, 2016 in the amount of $12,250 for Horace Greeley Cafeteria Renovation Enhanced Construction Administration, and authorizes the Board President to execute this Agreement.

 

 

5.8

BE IT RESOLVED that the Board of Education approves an Agreement with Woodard & Curran Engineering dated March 4, 2016 in the amount of $21,500 for Horace Greeley Competition Field Electrical Engineering Consulting Services, and authorizes the Board President to execute this Agreement.

 

 

5.9

BE IT RESOLVED that the Board of Education approves an Agreement with Student Assistance Services for the 2016-2017 school year for a five-day per week Student Assistance/Project SUCCESS Program at Horace Greeley High School in the amount of $69,940, and authorizes the Board President to execute this Agreement.

 

 

5.10

BE IT RESOLVED that the Board of Education approves an Agreement for Health and Welfare Services with Katonah-Lewisboro Union Free School District for 16 students at a rate of $1,106.50 per student, effective September 2, 2015 to June 23, 2016, and authorizes the Board President, Superintendent, and District Clerk to execute this Agreement.

 

 

5.11

BE IT RESOLVED that the Board of Education approves an Agreement with Westchester Community Opportunity Program, Inc. (WESTCOP) to renew the current contract for 2016-17 for the Head Start Program at Douglas Grafflin Elementary School with a 0% increase for a total of $50,682, and authorizes the Board President to execute this Agreement.

 

 

5.12

WHEREAS, Heartland Payment Systems, ("Heartland") is and will continue to be, the sole source of the NUTRIKIDS POS Serving Line Software. This also includes NUTRIKIDS Software products, support, updates, and training. These items are proprietary products that are only available through Heartland Payment Systems located at 787 Elmgrove Road, Building 1, Rochester, NY 104624.

WHEREAS, Heartland will have a direct sales and purchasing relationship and no intentions to utilize agents, or authorize resellers to provide Nutrikids products and services to Chappaqua School District.

THEREFORE, BE IT RESOLVED, that the Board of Education hereby declares Heartland to be the sole source for all Nuttrikids branded products and services purchased in the ordinary course of product acquisition and therefore, determines that the purchase of the Nutrikids products is not subject to competitive bidding under Section 103 of the General Municipal Law.

Resolution to Refund and Credit Basic STAR for parcel 93.10-2-3 in the amount of $1,729.

Approve a check from Target "Take Charge of Education" campaign in the amount of $977.02 to Westorchard Elementary School for "Sustainable Energy Projects" through the District.

CCSD Bid #948 - Driver's Education - PAS Auto School at a rate of $445 per student for summer session and $445 per student for fall/spring session for the 2016-17 school year.

 

 

5.16

CCSD Bid #947 - Graduation Tent and Chair Rental - recommended award to Cantele Tent Rentals - $23,602.50 for the 2015-16 school year.

CCSD Bid #911 - Environmental Services and Maintenance - recommended award to Optima Environmental Services, Inc. (formerly Conklin Services and Construction, Inc.) - Cost for one year - $14,000; time & material cost for one year - $98 per hour plus 20%. (0% increase) for the 2015-16 school year.

 

 

5.18

WHEREAS, the District owns the attached list of items which are no longer useful or necessary for school district purposes and of no value to the School District;

THEREFORE, BE IT RESOLVED that the Board hereby declares such items to be surplus property and of no value to the School District and authorizes the disposal of such equipment in a prudent manner in accordance with law.

BE IT RESOLVED that the Board of Education approves a budget transfer of $102,000 to cover costs associated with maintenance share for out-of-district students, and authorizes the Board President and Superintendent to execute this transfer.

BE IT RESOLVED that the Board of Education approves a budget transfer of $100,000 to cover costs expenses through June 30, 2016 for Shaw Perelson & May, and authorizes the Board President and Superintendent to execute this transfer.

BE IT RESOLVED that the Board of Education approves an Amended Agreement with Alexandra Walsh from December 1, 2015 through June 30, 2016, the total payment for the 2015-16 school year shall not exceed $9,000 (increased from $6,000), and authorizes the Board President to execute this Agreement.
